立法院長王金平黨籍訴訟案二審今天開庭。國民黨律師說，王金平關說司法是嚴重的事，法國前總統沙柯吉涉司法關說即遭羈押。王的律師則反指國民黨違反處分規則在先。

台北地方法院在今年3月間宣判，判決王金平勝訴，國民黨不服提起上訴，台灣高等法院今天上午再次開庭，進行爭點整理。

王金平委任律師許英傑表示，國民黨違反處分規則，竟「先執行再送達」。執行部分，當天撤銷黨籍證明書送交中選會，但送到前，國民黨並未對王金平送達或公告這份「撤銷黨籍」處分，顯然違反處分規則。

許英傑舉例，像立委陳學聖被停止黨權一例，就是有檢附送達證據，再依作業流程執行，反觀王金平的處分卻未依程序，國民黨草率、始無前例。

國民黨委任律師羅明通則說，陳學聖是停止黨權，並非撤銷黨籍，與本案無關。

羅明通說，王金平涉司法關說案，就如法國前總統沙柯吉（Nicolas Sarkozy）涉關說遭羈押一樣情節重大，法官可以考量傳喚關說案相關人到庭說明。(中央社)
