白文正遺產 二房告輸大房

（中央社記者黃意涵台北26日電）前寶來證券董事長白文正逝世後，二房兒子白介芃對大房魏明春提起剩餘財產分配訴訟。最高法院判決白介芃敗訴定讞。

白文正於2008年7月2日到澎湖投海自盡後，大房魏明春、二房葉美麗對遺產總金額、分法各有主張，相互提告。

根據法院判決書，白介芃主張，魏明春未將夫妻剩餘財產分配部分計算後，列入遺產申報，他因此提起訴訟，請求魏明春向繼承人報告白文正過世時的財產狀況，並請求分配魏明春夫妻剩餘財產的差額。

魏明春則主張，白文正的其餘繼承人已表示不願向她行使夫妻剩餘財產分配請求權，白介芃不能單獨訴請分配差額。

台灣高等法院審理認為，夫妻間才有「互負婚後財產報告義務」的規定，白介芃無權請求魏明春報告。此外，請求分配剩餘財產差額的規定，是要保護婚姻中經濟弱勢的配偶一方，但白介芃對於魏明春的婚姻並無貢獻，因此駁回白介芃之訴；全案經最高法院駁回上訴定讞。1030226
