我和人家發生車禍 我半夜閃黃登時正常行駛道十字路口右轉 馬上發現有機車在路中間於是我閃避不及撞上了

事後我有申請初步分析研判表

寫對方 酒駕..濃度值0.63毫克

寫我 不依規定駛入來車道

請問這樣是誰對誰錯呢?
我有辦法向對方求償嗎?
因為轉彎有時太大當然會不小心壓到雙黃線 但是我正常行駛也不知道自己有沒有押到線 可是他就是寫我不依規定駛入來車道.....
